Kotak Cherry Platform/Account may be susceptible to a number of frauds, misuse, phishing, hacking and other actions, which could affect the instructions sent to the Company /its authorised representatives. The Company does not provide any guarantees against such internet frauds, phishing, hacking and other actions.
Whilst every reasonable precaution has been taken to ensure the accuracy, security and confidentiality of data and information available through the Kotak Cherry Platform, the Company and its service providers shall not be held responsible for any consequence of any action carried out by you
The services/facility may be suspended or withdrawn at any time, and you acknowledge that the Kotak Cherry Account is also subject to interruption
You acknowledge and agree that the Website and the linked backend infrastructure may be inaccessible and/or unavailable at times. In such an event the Company will not be liable for any damage, liability, action, cause of action, suit, claim, demand, loss, cost, and expense arising directly or indirectly from or in connection with such system inaccessibility and/or unavailability.
The Company makes no express or implied warranty:
- that the dealing through the Company account will be uninterrupted or free from errors or that any identified defect will be corrected
- in relation to non-infringement of any third-party rights, merchantability, satisfactory quality or fitness for a particular purpose.
The Company and its service providers shall not be liable for any loss or damage or other consequences arising from any suspension, breakdown, withdrawal, interruption, technical flaw, the presence of virus or other malicious, destructive or corrupting code, programs over the Kotak Cherry Account or otherwise and any consequent delay or failure in completion of any payment or other instructions as a consequence thereof arising from the use or inability to use the Kotak Cherry Account.
Client will not solely rely on the views, representations (whether written or oral or otherwise), recommendations, opinions, reports, analysis, information or other statement made by the Company or any of its agents, directors, officers or employees and that the Client will make the Client's own assessment and rely on the Client's own judgment in making any investment decision. In the event that the Client seeks to make an investment pursuant to the information or recommendation provided by the Company, the Client shall do so at their own risk, and should consider their financial situation, objectives and needs and consult with their legal, business, tax and/or other professional advisors to determine the appropriateness and consequences of such an investment. The Client may, at their own discretion, opt not to follow the investment / product / recommendations provided by the Company, if any, irrespective of whether they are in line with the objectives / requirements specified in this document or the assessment derived from the details provided herein. The Company does not assure or guarantee any returns in relation to the investment profile it may generate. The Company and/or any of its subsidiaries/group companies/agents/vendors along with all their Directors/officers/employees and agents shall not be responsible for the amount / value of profit earned / loss incurred by the Client or its variance from the mean / any other ratio used to evaluate the returns from the mutual funds/ market / alternate products / portfolios, that the Client may have earned.
Third Party Investment products are not obligations of or guaranteed by the Company or any of its affiliates or subsidiaries, and are subject to various risks, including the possible loss of the principal amount invested.
Investment in Securities including Mutual Fund investments are subject to market risks, read all scheme/product related documents carefully.

The Client shall notify the Company of any material change in its/his/her situation and/or profile and the Company is entitled to rely on the most recent information provided by the Client.
The Client who uses any service on the Kotak Cherry Platform agree that any fee paid, including taxes thereon, is non-refundable including in case of deactivation, unsubscribing the services or in any other circumstances.
Kotak Cherry Platform may earn / reserves the right to earn commission, brokerage, referral fees etc. for various financial products being distributed by it (except for Mutual Funds, on which Kotak Cherry shall not earn any commission)
The Client understands that all services shall be provided online on www.kotakcherry.com, his/her email id and mobile number registered with the Company. In case of any change in his/her email id and/or mobile number, he/she shall inform the Company in advance in the prescribed format to carry out the necessary changes in its records. He/ She confirms that the information/details provided by him /her is true, accurate, correct and complete.
The Client confirms that the Company shall have the right to withdraw the services offered at any time without providing any reason whatsoever and without giving any prior notice.
The Client agrees to be contacted by the Company and its representatives over phone or on registered email id with reference to the service.
The Client agrees and confirms that the Company may call them on their contact number for providing transaction related assistance (“Voice Services” ) and the Company may use the services of a third party service provider for such Voice Services.
The Client understands that he/she can close the Kotak Cherry Account or unsubscribe to any services online.
The money you transfer is remitted to the bank account of the Asset Management Company (in case of mutual funds), to stock exchange (in case of equities) and to Kotak (in case of bonds). Once a transaction is completed, it cannot be cancelled. The investor has to withdraw the money from the respective product (mutual funds, equities, etc.). In case of bonds, withdrawal is not allowed until maturity of the bond. If there are issues during the transaction process, the refund is processed in 5-7 working days. Investors can only use the bank account registered with Kotak Cherry for the transactions.
